Article 3: Contractual documents

This contract is formed by the following contractual documents, presented in descending hierarchical order: these General Conditions of Sale (including the guarantee), the order form, the electronic order confirmation.

In case of contradiction between the provisions contained in the documents of different rank, the provisions of the document of higher rank will prevail.


Article 4: Entry into force - duration - access

4-1 These General Conditions come into force on the date of validation of the order form and are concluded for the duration necessary for the supply of the goods and services subscribed, until the expiry of the guarantees due by the company BAMBIGROUP

4-2 BAMBIGROUP reserves the right to modify and update, without notice, these general conditions and all the elements presented on the site. All of these modifications are binding on users as soon as they are put online and cannot be applied to transactions concluded previously.

4-3 Availability of access to the site:

Article 6: Order confirmation

Article 7: Proof of the transaction

Article 8: Order processing

8.1 Information to be provided when ordering

The buyer verifies the completeness and conformity of the information he provides when ordering, in particular the name, the delivery address and all the mandatory fields when entering his account. BAMBIGROUP cannot be held responsible for consumer input errors and the resulting consequences (delays or delivery errors, for example). The costs incurred in this context, for the reshipping of the order for example, will be borne by the consumer.

8.2 Anti-fraud checks

In order to ensure the security of transactions and to meet the concern of the greatest number of people to prevent fraud in distance selling, we carry out random checks on the placing of orders. Article 10: Price

The prices are indicated in Euros all taxes included for the EU and HT for foreign countries and DOM. They are only valid on the date of validation of the purchase order by the buyer (electronic acceptance). Unless otherwise specified on the site, they include preparation and delivery costs for mainland France and Monaco exclusively. For deliveries in Corsica, Dom Tom or to foreign countries, the price of transport and any specific preparation will be indicated to the consumer before the final validation of the order and any shipment. It should be noted that all the products present on the site are suitable for sale in France and generally in Europe, but legal obligations specific to certain countries may prevent the marketing of certain products in these countries.

The prices for the European Union take into account the French VAT applicable on the day of the order. Any rate change will automatically be reflected in the price of the products in the online store.

The period of validity of our offers and prices is 5 working days from the electronic validation of the order.

Payment of the full price must be made when ordering. At no time can the sums paid be considered as a deposit or down payment.

Within the framework of eco-contributions, certain products, depending on the category to which they belong, bear an eco-contribution tax included in our sales prices including VAT.


Article 11: Method of payment

BAMBIGROUP notably reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully or partially paid a previous order or with whom a payment dispute is in progress. administration.

Deliveries in Switzerland: the products are delivered duty free. You will have to pay VAT at the Swiss rate in force as well as all customs clearance costs.


Article 12: Availability of products

The order will be executed at the latest within a maximum period of 6 days from the day following that on which the buyer placed his order. In case of unavailability of the product ordered, due to force majeure, the user will be informed as soon as possible. The buyer will then have the choice of requesting either a refund of the sums paid within 14 days of their payment at the latest, or the sending of another product.

Article 13: Terms of delivery

For deliveries in mainland France and Monaco, the products are delivered to the address indicated by the buyer on the order form. (home, work, relay point, etc.). Additional costs may be requested if the customer chooses home or workplace delivery when the pick-up point option (free) is available.

In addition, a paid option for delivery within 48 hours guaranteed can be offered at the time of payment (excluding Sundays and public holidays).

For any other destination, including Corsica, a contribution to the shipping costs will be requested and indicated before definitively validating the order and any shipment.

For delivery outside the EU (for example in Switzerland) and DOM: the products are invoiced excluding taxes. The buyer must pay VAT at the local rate in force in his country as well as all customs clearance costs. The buyer is required to check the condition of the packaging, the condition of the goods and the number of packages on delivery. The buyer is required to report any damage due to transport or missing packages on the delivery note. Any absence of complaint at the time of delivery duly recorded on the delivery note of the carrier and countersigned by the carrier will cancel any subsequent claim concerning any damage suffered as a result of transport. In order to minimize transport costs, BAMBIGROUP will choose the most suitable carrier itself. Very large orders will be delivered by courier specialized in courier service. If the delivery is more than 30 days after the date of purchase of the product, the buyer may have his order canceled and be reimbursed in full within a maximum of 14 days.

In the event of absence at the time of delivery and/or in the event of force majeure and/or during busy periods, the package may be made available at a relay point at the free choice of the carrier and/or in certain cases at the choice of the recipient upon information from BAMBIGROUP .

In the event of unavailability of the relay point chosen at the time of the order, the package may be directed to another relay point at the free choice of the carrier and/or in certain cases at the choice of the recipient upon information from BAMBIGROUP .

 

Article 14: Delivery problems due to the carrier

14.1 : Late delivery, loss of order and/or delivery anomaly:

In the event of late delivery in relation to the shipping date + 7 days, the buyer must report this delay by sending an e-mail to contact@bambisol.com. We will then contact the carrier to trace the shipment. If the product is found, it will be re-routed immediately to your home (most cases).

If, on the other hand, the product is not found at the end of the period of 21 days of investigation, the parcel will be considered lost and may be the subject at that time of a replacement at our expense. If the product(s) ordered were no longer available at that time, we will, within a maximum of 14 days, reimburse the amount of the products concerned by the loss of the carrier by any means at our convenience. BAMBIGROUP cannot be held responsible for the extension of delivery times due to the carrier, in particular in the event of loss of products or cases of force majeure (strikes, etc.).

14.2 : Any anomalies concerning the delivery (damage, missing product compared to the delivery note, damaged package, broken products, etc.) must imperatively be indicated on the delivery note in the form of detailed handwritten reservations (product out of order, open box missing item etc. …), accompanied by the signature of the consumer and the deliverer. At the same time, the buyer must confirm this anomaly by sending the carrier within three (3) working days following the date of delivery, a registered letter setting out the said complaints. Article 15: Delivery errors due to BAMBIGROUP .

15.1 : The buyer must formulate with BAMBIGROUP on the same day of delivery or at the latest on the first working day following delivery, any complaint of error of delivery and/or non-conformity of the products in quantity with respect to the indications appearing on the purchase order. Any complaint made after this period will be rejected.

15.2 : The formulation of this complaint with the delivery service of BAMBIGROUP must be made by e-mail to: contact@bambisol.com

15.3 : Any complaint not made in the rules defined above and within the time limits cannot be taken into account and releases BAMBIGROUP from any liability vis-à-vis the consumer.

15.4 : Upon receipt of the complaint, the BAMBIGROUP delivery service . will allocate, if necessary, an exchange voucher for the product(s) concerned and will communicate it by e-mail to the consumer. The exchange of a product can only take place after the attribution to the consumer of an exchange voucher according to the approach presented above.

15.5 : In the event of a delivery or exchange error, any product to be exchanged or refunded must be returned to BAMBIGROUP , intact, as a whole and in its original packaging, according to the means of transport indicated and at the address indicated by the BAMBIGROUP delivery service . on the voucher.

To be accepted, any return must be notified in advance to the delivery service of BAMBIGROUP at the email address contact@bambisol.com. The shipping costs are the responsibility of the BAMBIGROUP company except in the event that it turns out that the returned product does not correspond to the original declaration made by the buyer in the return form.

Article 16: Delivery problem caused by the buyer

BAMBIGROUP SAS cannot be held responsible for the consequences in the event of the buyer's absence at the time of delivery:

  • increase in delivery time
  • drop off at relay point
  • return of the goods to its premises

The buyer must imperatively at the time of the order provide complete contact details: address, door codes / gates, intercoms, valid and accessible telephone numbers, email address.

It is his responsibility

  • to use the means communicated on his order confirmation or in his customer account (name of the carrier, package number, etc.) to ensure the follow-up of his order and
  • to respond to any message or call useful for the smooth running of its delivery.

The costs incurred in this context, for the reshipping of the order for example, will be borne by the consumer.


Article 17: Product warranty, Liability

17.1 Terms of application

 

Products purchased on www.bambisol.fr are covered by the guarantees specified in article 17-2 guarantees, below.

The support request must be made in writing to sav@bambisol.com . Customer service may be required to request a photo/video and additional information on the defect noted. BAMBIGROUP customer service will then decide what to do.

If support is granted, all costs will be borne by BAMBIGROUP (repair, parts, labor and transport) with the exception of transport costs for sales concluded outside mainland France and Monaco or if the buyer no longer has an address in mainland France and Monaco at the time of the complaint.

Otherwise, an estimate will be established notifying the conditions of repair (parts, labor if necessary, transport)

17.2 Warranties

- The consumer has a period of 2 years from delivery of the goods to act.

- The consumer can choose between the repair and the replacement of the good. As specified in article L211-9 of the Consumer Code, the seller may however choose another method than that chosen by the buyer if this choice entails a manifestly disproportionate cost with regard to the other method.

- The consumer is exempted from providing proof of the existence of the lack of conformity of the good when he acts within six months of the delivery of the good. This period is extended to twenty-four (24) months from March 18, 2016, except for second-hand goods.

- The legal guarantee of conformity applies independently of the commercial guarantee possibly subscribed.

- The consumer can decide to implement the guarantee against hidden defects of the thing sold. In this case, he can choose between rescinding the sale or reducing the sale price.

 

If an anomaly occurs during the period of validity of the guarantee, BAMBIGROUP SAS undertakes to respect the guarantee conditions described below. The products sold comply with the standards in force, they do not present any known design and/or manufacturing defect at the time of sale. If after purchase, during the warranty period*, the product presents a defect and this in the context of use as defined in the instructions for use, we undertake in the order described below:

- to ship the defective interchangeable part(s) yourself, or

- to repair the products or, as a last resort,

- to exchange the product in its entirety for an identical or similar product of at least equal value.

This guarantee does not apply in the cases below:

1°) wear of certain components of the product **

2°) failure to present a dated proof of purchase from a known retailer (invoice or receipt)

3°) use and destination other than those provided for in the instructions

4°) installation or assembly of the product or accessory not in accordance with the instructions

5°) repair carried out by an unauthorized person and beyond the control of our departments.

6°) lack of maintenance of the product. Proper maintenance is an integral part of the warranty claim.

7°) deterioration due to untimely impact and/or improper handling of the product.

The warranty is not transferable (only the first purchaser is the sole beneficiary) and applies from the date of acquisition of the product. If, during the two years following the purchase, the product is repaired under the legal guarantee of conformity, the customer will benefit from an additional 6 months of guarantee, i.e. a total guarantee of 30 months (2 years + 6 months). We undertake to carry out any repairs within a reasonable time. Within the framework of the exclusions, the actions to be carried out can be free or paid according to the analysis of our services.

*As regards the duration of the warranty against defects of conformity, consult the conditions provided for by the applicable national regulations, where applicable in the country of purchase. (France/Europe = 2 years).

** (For example the wear of wheels/castors; accessories and/or textile parts eg: railings, shelves, parasols, changing bag, rain cover, etc.; textile or PVC products eg: seat cover car, chair cushion etc. ...)

 

This guarantee is based on the consumer code art L217.4 and .5 and in any event the buyer benefits from the guarantee for hidden defects.

17.3 Liability

BAMBIGROUP SAS cannot be held liable in the event of non-compliance with the legislation of the country other than the common European regulations, where the products are delivered . It is up to the consumer to check with the local authorities the possibilities of importing or using the products or services that you plan to order.

Article 18: Return of the order

No total or partial order can be returned without the prior agreement of BAMBIGROUP SAS.

Whatever the reason

Article 19: Return of used products

Used products that can be transported without equipment are not taken back by our delivery service provider. 20: Right of withdrawal

In accordance with article L.121-20 of the Consumer Code, the buyer has a period of 14 calendar days from receipt of his goods to assert his right of withdrawal. The return transport of the product(s) subject to the withdrawal is the responsibility of the customer. Any withdrawal must be made via the pre-filled form made available on the site at the bottom of the page.

The product must be returned intact, as a whole and in its original packaging, to the address indicated by the BAMBIGROUP consumer service . Only products returned as a whole will be taken back, in their complete and intact original packaging, and in perfect condition for resale. Any product that has been damaged, or whose original packaging has been damaged, will not be refunded or exchanged.

BAMBIGROUP has a period of 14 days from the date of exercise of the right of withdrawal to proceed with the reimbursement of the goods, it being understood that the reimbursement may be deferred until the recovery of the goods or until the buyer has provided proof of shipment.


Article 21: Force majeure

Neither party will have failed in its contractual obligations, insofar as their execution is delayed, hindered or prevented by a fortuitous event or force majeure. Warranty exclusions: BAMBIGROUP cannot guarantee the proper functioning of the Internet as a whole. Consequently, BAMBIGROUP assumes no liability or guarantee in the event of malfunction of the Internet (delay in transmissions or any other malfunction).

Consumers use this site under their sole responsibility. BAMBIGROUP cannot be held liable for direct or indirect damage, such as material damage, loss of data or programs, financial loss, resulting from the use of this site or sites linked to it.


Article 22: Partial non-validation

If one or more stipulations of these General Conditions are held to be invalid or declared as such pursuant to a law, a regulation or following a final decision of a competent jurisdiction, the other stipulations will retain their full force. and their scope.
